Once again we round-up the stats for the Hawaii appellate courts for the previous month.
In the month of November 2012, 84 opinions and orders were issued by the courts, down from 98 in October. The following is a break-down of how the numbers fell:

Justice Acoba issued an opinion concurring in part and dissenting in part from an order accepting cert in State v. Shyanguya here, and a dissenting opinion from an order denying reconsideration in Tierney v. State here.

A few observations about this month’s stats:
(1) The decrease in the total number of opinions issued this month as compared to last month is due, in part, with the greater than average number of published opinions issued last month by the HAWSCT;
(2) The number of cert applications disposed of is once again showing a sustained double digit amount;
(3) Family law and criminal law continue to be the subject matter of most of the cert applications disposed of by the HAWSCT;
(4) TIME TO DISPOSITION:
For ICA opinions, we track the time from the date the merit panel is assigned. For HAWSCT opinions, we track the time from the date a cert application (or application to transfer or other direct appeal) is filed. The time to disposition for transfer application to the HAWSCT is generally longer than for cert applications because the parties must brief the case (if the briefing has not already been submitted to the ICA prior to transfer).
